This text is published in Turkish and English. For users in Türkiye, the Turkish text prevails in case of conflict; for users outside Türkiye, the English text prevails.

1. Parties

1.1. These Terms of Service ("Terms") are between Ali Ravza Barlak, sole proprietorship ("Craft"; VKN 1421541880; tax office [[STUB: vergi dairesi]]; address Üniversite Mah. Eskimezarlık Sok. No: 16/16, Ortahisar, Trabzon; KEP aliravza.barlak@hs01.kep.tr; email info@usecraft.app) and the person using the Craft AI workspace ("Service") ("User").

1.2. The Terms take effect when the User accepts them electronically and remain in force until ended under these Terms.

2. Subject and plans

2.1. These Terms govern use of the Service (canvases, chat, vault uploads, agents and related features) and the data the User uploads ("Content"). The Service is a cloud-based (SaaS) digital service; there is no physical delivery.

2.2. Plans: Free; $20/month; $60/month. Scope and limits are shown on the pricing page. Paid plans start on [[STUB: ücretli plan açılış tarihi]].

2.3. Paid purchases are additionally governed by the Distance Contract, Withdrawal and Refund Terms (distance-contract-withdrawal-refund.en.md) and by Paddle's Buyer Terms (Paddle is the seller — see §8).

3. Account and age

3.1. The User must give accurate, current information and keep it up to date.

3.2. The Service is only for persons aged 18 or over. At sign-up the User declares this by ticking a separate, unticked box. If the User acts for a business, they confirm they are authorised to bind it.

3.3. The User keeps credentials confidential and promptly reports unauthorised use. The User is responsible for activity under the account, except activity caused by Craft's fault.

4. Acceptable use

The User must use the Service lawfully. Prohibited: fraud; spam; identity theft; unauthorised access; attacks; malware; reverse engineering or attempting to obtain source code; overloading the system or circumventing limits; creating multiple accounts to obtain extra trials or limits; infringing third-party rights; unlawful content.

5. Content and intellectual property

5.1. Content belongs to the User. Craft receives only the non-exclusive right needed to host, store, back up, transmit and process Content to provide the Service.

5.2. The software, interface, brand and documentation belong to Craft or its licensors; the User receives a limited, non-exclusive, non-transferable right of use.

5.3. Team workspace content is governed by the team's settings; deleting one member's account does not delete team content.

6. Artificial intelligence

6.1. AI output may be inaccurate, incomplete or out of date and is not professional advice. The User must review it before relying on or publishing it and is responsible for how it is used.

6.2. AI providers: OpenAI, Google, Anthropic, xAI. Model training is turned off (opt-out enabled) with all four; Craft does not train models on User data. Details: ai-disclosure.en.md.

7. Free trial

7.1. Craft may offer new Users a free trial of paid features for up to 3 months. Craft sets the eligibility requirements, duration, features and usage limits of trials.

7.2. Craft may change or end trial terms, duration and limits prospectively. Changes apply to trials started after the change; for a running trial, Craft gives notice in the Service or by email before a change takes effect. Craft may end a trial immediately in case of abuse or breach of these Terms.

7.3. One trial per User. A person may not obtain additional trials through additional accounts, email addresses or other means.

7.4. No silent charge. The trial does not convert to a paid subscription automatically. A paid plan starts only when the User expressly purchases it at checkout. Craft does not charge the User at the end of a trial unless the User has entered payment details and expressly agreed at checkout to the price and start date of the paid plan.

7.5. When a trial ends without a purchase, the account moves to the Free plan; access to trial-only features ends and Content above Free-plan limits may become read-only.

8. Fees, payment and Paddle (seller / Merchant of Record)

8.1. Paid plans are sold by Paddle.com Market Limited (United Kingdom), which acts as Merchant of Record and reseller. Paddle handles payment, invoicing, tax and card processing under the Paddle Buyer Terms and Refund Policy. Craft provides the Service.

8.2. Prices and taxes are shown at checkout before payment.

8.3. Monthly and annual subscriptions renew for the same period until cancelled; the renewal terms are shown and accepted at checkout.

8.4. If a payment fails, Paddle may retry and access to paid features may be limited until payment succeeds.

9. Annual discount (about 20%) — not binding

9.1. Craft may offer a discount of about 20% on annual plans. The discount is not guaranteed and is not a permanent commitment.

9.2. Craft may change, reduce or withdraw the discount for future periods: for new purchases and for renewal periods that have not yet started. Such a change is announced like a price change (§10).

9.3. Periods already purchased are honoured. For an annual period the User has already paid for, the discounted price accepted at purchase remains the price for that whole period.

10. Price changes

10.1. Craft may change subscription prices. Changes are announced by email and in the Service at least 1 (one) month before they take effect.

10.2. The current paid period keeps the old price. A new price applies only from the first period that starts after the notice period has expired.

10.3. A User who does not accept the new price may cancel before the new price applies; no new-price charge is made in that case.

11. Withdrawal, cancellation and refunds (summary)

11.1. Consumers have a 14-day right of withdrawal, subject to the digital-content/immediate-performance exception with express consent (Distance Contracts Regulation m.15). Where Paddle's Refund Policy is more favourable, it applies.

11.2. The User may cancel the subscription at any time. Refunds of the unused remaining amount, where due, are made within 15 days (Subscription Contracts Regulation m.25(3)).

11.3. Full rules: distance-contract-withdrawal-refund.en.md.

12. Changes to the Service

12.1. Craft may develop, change, add or remove features, models, providers and limits of the Service. Craft will not make changes that materially reduce a paid plan's core features during a period already paid for, unless required by law, security or a provider's discontinuation.

12.2. If Craft discontinues the Service or a paid plan, it gives reasonable prior notice and refunds the unused part of prepaid fees pro rata.

13. Suspension and termination

13.1. Craft may suspend access, wholly or partly, if the User breaches these Terms or the law, if payment fails, or where security or a legal obligation requires it. Where possible Craft gives notice and a reasonable time to cure; it may act immediately for security, abuse or legal reasons.

13.2. Craft may terminate the account for serious or repeated breaches or unlawful use.

13.3. If Craft terminates without the User's breach, it refunds the unused part of prepaid fees pro rata.

13.4. Payment obligations that arose before suspension or termination remain. Statutory consumer rights are reserved.

14. Account closure and deletion

14.1. The User may close the account at any time in the Service. Personal data is then permanently deleted within 30 days. The User may also request deletion by emailing gdpr@usecraft.app.

14.2. The User should export Content before closing; deleted data cannot be restored. Team workspace content is not deleted with one member's account. Statutory retention obligations are reserved.

15. Disclaimer

15.1. The Service is provided "as is" and "as available". To the extent permitted by law, Craft gives no warranty that the Service or AI output will be uninterrupted, error-free, accurate or fit for a particular purpose.

15.2. Nothing in these Terms limits rights that consumers have under mandatory law.

16. Limitation of liability

16.1. To the extent permitted by law, Craft is not liable for indirect or consequential loss, loss of profit, revenue or data, or loss caused by third-party services (including AI providers) beyond Craft's control.

16.2. To the extent permitted by law, Craft's total liability is limited to the greater of USD 100 or the fees the User paid for the Service in the 12 months before the event giving rise to the claim.

16.3. These limits do not apply to intent, gross negligence, fraud, personal injury, or liability that cannot be limited under mandatory law (including consumer rights).

17. Indemnity (business users)

A User acting for business purposes indemnifies Craft against third-party claims arising from that User's unlawful Content or breach of these Terms. This clause does not apply to consumers.

18. Personal data

Personal data is processed under KVKK, the GDPR where applicable, and privacy-policy.en.md. Subprocessors: subprocessors.en.md. No newsletter or marketing messages are sent at launch.

19. Changes to the Terms

Craft may change these Terms. Material changes are announced at least 1 month in advance by email and/or in the Service. A User who does not accept them may cancel before they take effect. Changes to the consumer's detriment do not apply to a paid period already running (6502 m.4/2).

20. Force majeure

Obligations are suspended to the extent affected by events beyond reasonable control (natural disasters, war, epidemics, official decisions, widespread infrastructure outages, cyber-attacks).

21. Notices and electronic records

Notices are sent to the registered email or shown in the Service. Electronic records may be used as evidence as permitted by law; there is no conclusive-evidence agreement against consumers.

22. Governing law and disputes

22.1. Turkish law governs. Mandatory consumer protections of the User's country of residence are reserved.

22.2. Consumers may apply to the Consumer Arbitration Committees (within monetary limits) and Consumer Courts; statutory venue rights are not limited.

22.3. For Users who are not consumers, the courts of Craft's registered address (§1) have jurisdiction.

23. Miscellaneous

If any provision is invalid, the rest remain in force. Mandatory law prevails over these Terms.
